Detailed Explanation of the latest Immigration Covid-19 Regulation 

(NOMOR: IMI-GR.01.01-1102 TAHUN 2020 of 10/07/2020, effective 13/07/2020)

 

The new regulation is applicable for the following groups of foreigners: 

  1. ITAS and KITAP stay permit holders, who are now abroad, and their stay permit or Re-entry permit (IMK or MERP) has expired. 
  2. Visit Visa (ITK) holders and ITAS / KITAP holders, who are in Indonesia and carrying a valid visa or permit. 
  3. Visit Visa (ITK) holders and ITAS / KITAP holders, who are in Indonesia y carrying an Emergency Stay Permit (ITKT) needing a new visa or stay permit  
  4. Visa on Arrival (VOA or VKSK) holders, who are in Indonesia and received an Emergency Stay Permit (ITKT). 
  5. Free Exemption Visa (BVK) holders, who are in Indonesia and received an Emergency Stay Permit (ITKT). 
  6. Visit Visa (ITK) and ITAS stay permit holders, who are in Indonesia and already have telex visas, Notifications (from Manpower). 

 

The content and the consequences for each group:
 

  1. Temporary (ITAS) and permanent (KITAP) stay permit holders, who are now abroad, y their stay permit or Re-entry permit (IMK or MERP) has expired.
    1. If they have obtained a Notification from the Manpower Department and in the event of family reunification (for dependents), they can re-enter Indonesia to extend the permit stay at the local Immigration Office, within a maximum of 60 days from 13 July 2020, so before 11 September 2020. 
    2. If they don’t have a Notification or don’t come back before 11 September 2020, they are required to apply for a new Visa and ITAS / KITAP in accordance with the normal rules.
  2. Visit Visa (ITK) holders and Stay Permit (ITAS / KITAP) holders, who are in Indonesia and carrying a valid visa or permit can apply for an extension of their visa or residence permit at the Immigration Office in accordance with the normal rules. 
  3. Visit Visa (ITK) holders and Stay permit (ITAS / KITAP) holders, who are in Indonesia and carrying an Emergency Stay Permit (ITKT) and needing a new visa or stay permit.
    1. Visit Visa (ITK) holder 
      1. Visit Visa (ITK) holders who have obtained and Emergency Stay Permit (ITKT), can extend their residence permit based on the previous visa as long as  the Covid-19 pandemic period has not ended and there are no means of transportation to leave Indonesia.
      2. Visit Visa (ITK) holders who have extended their visa as referred to under point a) can apply for the transfer of status to a stay permit (ITAS) in accordance with the normal rules.
      3. Extension as referred to in letter a) must be made within 30 days from the 13 July 2020, so before 12 August 2020.
      4. Visit Visa holders who do not meet the provisions referred to in letters a), b) and c) are subject to Immigration Administrative Acts in accordance with normal rules and statutory provisions. 
    2. ITAS, Stay Permit holder 
      1. ITAS Stay Permit holders who have obtained an Emergency Stay Permit (ITKT), can apply for an extension of the residence permit based on the previous ITAS and in accordance with the normal rules.
      2. Stay permit holders who have extended their ITAS as referred to in letter a) can apply for the transfer of status to KITAP in accordance with the normal rules. 
      3. ITAS holders who have obtained an Emergency Stay Permit (ITKT) and which ITAS cannot be extended in accordance with applicable regulations, are obliged to leave the territory of Indonesia within 30 days after 13 July 2020, so before 12 August 2020.
      4. ITAS holders who do not meet the provisions under letter c) are subject to Immigration Administrative Measures in accordance with the normal rules.
    3. KITAP, Stay Permit holder 
      1. KITAP holders who have obtained an Emergency Stay Permit (ITKT) can apply for an extension of the residence permit based on the previous ITAP.
      2. KITAP holders who have obtained an Emergency Stay Permit (ITKT) and which ITAS cannot be extended in accordance with applicable regulations, are obliged to leave the territory of Indonesia within 30 days after 13 July 2020, so before 12 August 2020.
      3. KITAP holders who do not meet the provisions under letter b) are subject to Immigration Administrative Measures in accordance with the normal rules.
  4. Visa on Arrival (VOA or VKSK) holders, who are in Indonesia and received an Emergency Stay Permit (ITKT).
    1. VOA holders who have obtained an Emergency Stay Permit (ITKT) can extend their visa on the previous VOA until the Covid-19 pandemic period ends and there are no means of transportation to leave Indonesia. 
    2. Extension as referred to in number a) must be made within 30 days from 13 July 2020, so before 12 August 2020. 
    3. VOA holders who do not meet the provisions referred to in number a) and b) are subject to Immigration Administrative Measures in accordance with the normal rules.
  5. Free Exemption Visa (BVK) holders, who are in Indonesia and received Emergency Stay Permit (ITKT) facilities.
    1. Free Exemption Visa (BVK) holders who have obtained an Emergency Stay Permit (ITKT) must leave Indonesia within 30 days after 13 July 2020, so before 12 August 2020. 
    2. Free Exemption Visa (BVK) holders who do not meet the provisions referred to in number a) are subject to Immigration Administrative Measures in accordance with the normal rules.
  6. Visit Visa (ITK) and Stay Permit (ITAS) holders, who are in Indonesia now and already have telex visas (from Dirjen) and a Notifications (from Manpower).
    1. These foreigners/ expats can apply for the Visit Visa y/or Stay Permit (COMO) with the local immigration office without leaving Indonesia and without applying for a visa to an Indonesian representative abroad. 
    2. Visit Visas (ITK) and ITAS as referred to under number a) are granted after paying la visa fees at the local Immigration Office. 
    3. The visa fee as referred to under number b) is paid after a billing code received via the local Immigration Office and paid at a bank. 
    4. Proof of payment of the visa fees as referred to in number c) is considered as proof of having a Visa, which will be converted to an ITAS.
